Clery Act Compliance Committee Charter

Purpose
The Clery Act Compliance Committee (“the Committee”) is established to support the University’s compliance with the Jeanne Clery Campus Safety Act (“Clery Act”). The Committee ensures effective coordination of Clery-related responsibilities, promotes accurate and timely reporting, and advances the University’s commitment to campus safety, transparency, and accountability.

Scope
The Committee is responsible for overseeing institutional compliance with the Clery Act, including, but not limited to:

Collection, classification, and reporting of Clery crime statistics.

Oversight of the Annual Security Report (ASR) and Fire Safety Report
-
Timely Warnings and Emergency Notifications processes.
-
Maintenance and publication of the Daily Crime Log.
-
Training and guidance for Campus Security Authorities (CSAs).
-
Coordination of campus safety policies, procedures, and practices that affect Clery compliance.

Authority
The Committee serves as an advisory and oversight body to the University President (or designee) and reports through the Office of Legal Affairs and Compliance and/or MGA Police Department. The Committee may request data, documents, and input from any campus unit necessary for fulfilling its responsibilities.

The Committee will include representatives from areas critical to Clery compliance, including but not limited to:

Clery Coordinator

Office of Legal Affairs and Compliance

Student Affairs

Title IX Office
-
Director of Internal Audit

Athletics
-
Communications/Marketing (for Timely Warnings and Notifications)
Additional members may be appointed as deemed necessary.

Roles & Responsibilities
The Committee will:

Clery Data Collection & Reporting
-
Oversee crime data collection from internal and external sources (including local law enforcement).

Confirm that reported incidents are correctly categorized as Clery crimes and occur within Clery-reportable geography.

Annual Security Report
-
Review and approve the ASR before publication.
-
Ensure accuracy of policy statements and procedures included in the ASR.
-
Confirm that the ASR fulfills its role as a consumer report, providing students, families, and employees with transparent information about campus crime statistics and safety policies to support informed decision-making

Timely Warnings & Emergency Notifications

Review processes and protocols for issuing alerts.
-
Assess compliance with federal requirements.

Daily Crime Log
-
Ensure accurate and timely maintenance of the log.
-

Training & Awareness
-
Ensure proper identification and training of CSAs.
-
Promote awareness of Clery obligations campus wide.
-

Continuous Improvement
-
Stay informed about changes to federal law and Department of Education guidance and update University practices as needed to remain compliant.

Conduct annual self-assessments of the University’s Clery program.

Recommend policy or procedural improvements.

Meetings
- The Committee will meet quarterly at minimum, with additional meetings scheduled as needed (e.g., prior to ASR publication).
- Meeting minutes will be recorded and maintained by the Clery Coordinator or designee.

Reporting
- The Committee will provide an annual compliance report to senior leadership, highlighting accomplishments, challenges, and areas for improvement.
- Significant compliance risks or deficiencies must be escalated immediately to University leadership.

Review of Charter
This Charter will be reviewed every two years to ensure ongoing relevance and effectiveness. Amendments require approval from University leadership.
